1. About these Terms
1.1 These terms of use (Platform Terms) govern your access to and use of the Generation AI platform (the Platform), an online service made available by the Dubai Future Foundation (DFF, we, us, our), a Dubai government entity established pursuant to Dubai Law No. 19 of 2015 (as amended), with its address at 5th Floor, Emirates Towers, Sheikh Zayed Road, P.O. Box 555509, Dubai, United Arab Emirates. The Platform is available at https://gen.dub.ai/en.
1.2 The Platform forms part of our Services. These Platform Terms are Service-Specific Terms that apply in addition to, and form part of, the DFF Terms of Service and the Privacy Policy. Together, the DFF Terms of Service, the Privacy Policy and these Platform Terms are the Terms.
1.3 Capitalised terms used but not defined in these Platform Terms have the meaning given to them in the DFF Terms of Service, including Content, Services, User, you, your and Intellectual Property Rights.
1.4 If there is any conflict or inconsistency in respect of the Platform: (a) the Privacy Policy prevails over the other Terms in relation to the processing of personal data; and (b) these Platform Terms prevail over the general DFF Terms of Service. In all other respects the DFF Terms of Service continue to apply in full.
1.5 By accessing or using the Platform, or by clicking or selecting to accept these Terms, you confirm that you have read, understood and agree to be bound by the Terms. If you do not agree, you must not access or use the Platform.
2. Scope and purpose of the Platform
2.1 The Platform is an informational and educational tool that uses generative artificial intelligence to generate general information and responses (Outputs) in response to user prompts.
2.2 The Platform, its Content and all Outputs are provided for general information purposes only. They do not constitute, and must not be relied upon as, professional advice of any kind, including legal, regulatory, financial, investment, tax, medical or other professional advice, and do not represent the official position, decision or determination of DFF or of any Dubai Government entity.
2.3 Nothing on or in connection with the Platform creates any advisory, professional, agency or fiduciary relationship between you and DFF.
2.4 You are solely responsible for independently evaluating and verifying any Output before relying on or acting upon it, and for any decision you make. Your use of the Platform and any reliance on Outputs is entirely at your own risk.
3. Nature of AI-generated Outputs
3.1 Outputs are generated by automated, probabilistic artificial intelligence systems, based on your interaction with the Platform. They may be inaccurate, incomplete, misleading, out of date or otherwise unreliable, may not reflect current facts or law, and may not reflect the views of DFF or the Government of Dubai.
3.2 Outputs may differ between users and between sessions, even in response to identical or similar prompts. Outputs are not official statements of DFF or any government entity and must not be presented or relied upon as such.
3.3 Consistent with the DFF Terms of Service, we do not warrant the accuracy, reliability, quality, completeness, availability or fitness for purpose of the Platform or any Output, and we are under no obligation to update any Content or Output.
4. Who can use the Platform
4.1 The Platform is intended for adults. Consistent with the age requirements in the DFF Terms of Service, you must be at least 21 years old to use the Platform.
4.2 If you are under 21 years of age, you may use the Platform only with the express permission of your parent or legal guardian. Where a parent or legal guardian permits a person under 21 to use the Platform, these Terms apply to that parent or legal guardian, who is responsible for that person's use of, and activity on, the Platform at all times.
4.3 The Platform is not directed at, or intended for use by, children (each a child, being any person under the age of 18, or such other age as applicable law may specify). We do not knowingly permit children to use the Platform and do not knowingly collect personal data relating to children through the Platform.
4.4 If we become aware that a child has used the Platform, or that personal data relating to a child has been submitted contrary to these Terms, we may remove that data and suspend or restrict the relevant access, in accordance with the DFF Terms of Service.
5. Acceptable use and your inputs
5.1 In these Platform Terms, Inputs means any prompt, text, data, file or other Content that you submit to, or enter into, the Platform. You are responsible for your Inputs and for ensuring that you hold all rights, permissions and consents necessary to submit them.
5.2 You must not submit to the Platform, and must not use the Platform to process, any of the following:
- any personal data relating to a child, or any information that could identify or relate to a child;
- any personal data relating to any other individual or third party (that is, any personal data other than, where strictly necessary, your own);
- any information that is unlawful, or that is sensitive, confidential or proprietary, including sensitive personal data (or special categories of personal data), government-restricted, non-public or classified information, trade secrets, or any information that is subject to a duty of confidentiality or to contractual, professional or legal restrictions on its disclosure; or
- any Content that is otherwise prohibited under the DFF Terms of Service, including Content that:
- is misleading, fraudulent, or infringes the Intellectual Property Rights or privacy of any person;
- is defamatory, obscene, abusive, discriminatory, offensive, hateful or inflammatory, or that promotes or incites violence or illegal activity; or
- contains malicious code, or is submitted using scraping, data-mining, robots or other automated means, or in a manner that seeks to reverse-engineer or interfere with the Platform.
5.3 The licence restrictions and the "No Unlawful or Prohibited Use" provisions of the DFF Terms of Service apply in full to your use of the Platform.
5.4 We may (but are not obliged to) monitor, filter, screen, refuse, remove or alter any Inputs or Outputs, and may suspend, restrict or terminate your access to the Platform at any time, in accordance with the DFF Terms of Service.
6. Personal data and how we use your Inputs
6.1 Our collection, use and processing of personal data in connection with the Platform is described in the Privacy Policy.
6.2 As set out in the DFF Terms of Service, Inputs and other Content shared with the Platform's artificial intelligence may be processed, stored and used, including in aggregated form, to operate, secure, evaluate and improve the Platform and its capabilities, including as part of a machine learning process, subject to the Privacy Policy and applicable law. Such Content may be transported or stored by third-party service providers engaged to deliver the Platform.
6.3 Because Inputs may be processed and retained as described above, you must not submit personal data, sensitive information or confidential information, as set out in clause 5.
7. Intellectual property
7.1 All Intellectual Property Rights in the Platform and its Content are owned by or licensed to DFF and are dealt with as set out in the DFF Terms of Service.
7.2 Subject to the Terms and to applicable law, you may use Outputs for your own personal, non-commercial and lawful purposes. Outputs may be generic, and the same or similar Outputs may be generated for other users; you should not assume that any Output is unique or proprietary to you.
7.3 To the extent your Inputs contain Content, the licence you grant to DFF in respect of your Content under the DFF Terms of Service applies to those Inputs.
8. Third-party links and resources
8.1 The Platform, its Content and Outputs may contain, generate or refer to links to third-party websites, applications, resources or materials that are not owned or controlled by DFF. Any such links are provided for information and convenience only, and do not constitute any endorsement, verification, recommendation or approval by DFF of the linked site, resource or its content.
8.2 DFF does not control, monitor, verify or guarantee any third-party site, resource or content, and is not responsible for its accuracy, reliability, availability, legality, security or appropriateness. Third-party sites and resources are governed by their own terms of use and privacy policies, which you are responsible for reviewing.
8.3 Any access to or use of a third-party link, site, resource or content is entirely at your own risk. You are solely responsible for deciding whether to access any link, whether you require any other or professional support or advice, and how you use any information or material obtained from a third-party site or resource. To the fullest extent permitted by law, DFF is not liable in any way for any loss or damage arising out of or in connection with your access to, reliance on, or use of any third-party link, site, resource or content.
9. Disclaimers, liability and indemnity
9.1 The Platform, its Content and all Outputs are provided "as is" and "as available", without warranty of any kind. The disclaimers, exclusions and limitations of liability, and the indemnity, set out in the DFF Terms of Service apply in full to your use of the Platform, its Content and Outputs, and to any breach by you of these Platform Terms (including clause 5).
9.2 Without limiting those provisions, and to the fullest extent permitted by law, DFF is not liable for any loss or damage arising out of or in connection with your use of, or reliance on, the Platform or any Output. Your sole and exclusive remedy for any dissatisfaction with the Platform is to stop using it.
10. Changes, suspension and termination
10.1 We may update or modify these Platform Terms, and may update, suspend, restrict or withdraw the Platform (in whole or in part), at any time in accordance with the DFF Terms of Service. Updated Platform Terms take effect when published, and your continued use of the Platform after publication constitutes acceptance of the changes.
11. Governing law and jurisdiction
11.1 These Platform Terms and your use of the Platform are governed by and construed in accordance with the laws of the Emirate of Dubai and, where applicable, the Federal Laws of the United Arab Emirates. You irrevocably submit to the jurisdiction of the Courts of the Emirate of Dubai (as established by Law No. 3 of 1992 and Law No. 13 of 2016) in relation to all disputes arising out of or in connection with the Platform and these Platform Terms.
